Welcome to ImageBulk! These Terms of Service ("Terms") govern your access to and use of ImageBulk's website, services, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

ImageBulk provides an AI-powered background removal service that allows users to:

• Upload images for background removal processing
• Process images individually or in bulk
• Download processed images with transparent backgrounds
• Purchase credits to use the service
• Manage their account and credit balance

The Service is provided on a credit-based system. Each image processed consumes one credit from your account balance.

3. Account Registration

3.1 Account Creation

To use our Service, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Create a secure password
• Maintain the security of your account

3.2 Account Responsibility

You are responsible for:

• All activity that occurs under your account
• Maintaining the confidentiality of your password
• Notifying us immediately of unauthorized access
• Ensuring your account information is accurate and current

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion.

4. Credits and Pricing

4.1 Credit System

• New users receive 10 free credits upon registration
• Each image processed consumes 1 credit
• Credits do not expire
• Credits are non-refundable once purchased
• Credits cannot be transferred between accounts

4.2 Pricing Plans

We offer the following credit packages:

• Starter: $4.99 for 100 credits ($0.05 per image)
• Pro: $19.99 for 500 credits ($0.04 per image)
• Business: $49.99 for 2000 credits ($0.025 per image)

Prices are subject to change. We will notify you of any price changes before they take effect. Existing credits purchased at previous prices will remain valid.

4.3 Payment Processing

Payments are processed securely through Paddle.com. By making a purchase, you agree to Paddle's terms and conditions. We do not store your payment information.

4.4 Refund Policy

• Credits are generally non-refundable once purchased
• Refunds may be issued for technical failures on our end
• Refund requests must be submitted within 14 days of purchase
• Refunds are issued at our sole discretion

5. Acceptable Use Policy

5.1 Permitted Use

You may use ImageBulk to:

• Process images you own or have rights to use
• Create transparent background images for personal or commercial use
• Process images in compliance with all applicable laws

5.2 Prohibited Use

You may NOT use ImageBulk to:

• Upload illegal, harmful, or offensive content
• Process images containing child exploitation material
• Upload images you do not have rights to use
• Violate any person's privacy or intellectual property rights
• Abuse, harass, or harm others
• Attempt to bypass credit system or payment requirements
• Reverse engineer or copy our service
• Use automated tools to abuse the service (without permission)
• Resell or redistribute our service without authorization
• Upload malware or malicious code

5.3 Content Restrictions

Prohibited content includes but is not limited to:

• Child sexual abuse material (CSAM)
• Non-consensual intimate images
• Extreme violence or gore
• Hate speech or discriminatory content
• Copyrighted material you don't have rights to use
• Content that violates any applicable law

6. Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to the images you upload. By using our Service, you grant us a limited license to process your images solely for the purpose of providing the Service to you.

6.2 Our Service

ImageBulk and all related trademarks, logos, and service marks are owned by us or our licensors. You may not use our branding without written permission.

6.3 Processed Images

The processed images (with removed backgrounds) belong to you. You are free to use them for any lawful purpose. We claim no ownership over your processed images.

7. Service Availability and Limitations

7.1 Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted access to the Service. We may suspend or restrict access for maintenance, updates, or unforeseen issues.

7.2 Processing Limitations

• Maximum file size: 10 MB per image
• Supported formats: JPG, PNG, WEBP
• Processing time: typically under 30 seconds
• Bulk processing: up to 50 images at once

7.3 Rate Limits

To ensure fair usage, we may implement rate limits on API requests or image processing. Excessive usage may result in temporary restrictions.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

• We temporarily process your images to provide the service
• Images are automatically deleted within 24 hours
• We do not use your images to train AI models
• We do not sell your data to third parties

9. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR ALWAYS AVAILABLE.

9.2 No Guarantee of Results

While we strive for high-quality results, we do not guarantee that background removal will be perfect for every image. AI processing quality may vary based on image characteristics.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER DIRECT OR INDIRECT, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify and hold harmless ImageBulk, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Content you upload to the Service

11. Dispute Resolution

11.2 Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You agree to resolve disputes on an individual basis only and waive your right to participate in class actions or class-wide arbitration.

Upon termination, you will lose access to your account and any remaining credits. Credits are non-refundable except where required by law.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ImageBulk regarding the Service.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
